Guide on the December Holiday Pay 2024 Employees Are Entitled To

Every year, there are several special non-working days and regular holidays thus, what many people usually do is check on these days ahead. In other cases, there are a lot of individuals who make use of these holidays to spend some quality time with their loved ones or go on a much-awaited trip.
This December which is the peak of the holiday season in the Philippines, there are several special non-working days and regular holidays and many people are surely excited for the December holiday pay.
The Department of Labor and Employment or DOLE has released guidelines on the December holiday pay. Here is a guide for employers and employees:
December 8 (Feast of the Immaculate Concepcion), December 24 (Christmas Eve), and December 31 (last day of the year)
- DOLE stated in its guidelines that the “no work, no pay” rule applies if the employee does not report to work unless the company has adopted a policy over the holiday pay rules during the special non-working day.
- In the case of employees who will report to work, they are entitled to get an additional pay of 30% of the basic wage on the first eight hours of work (basic wage x 130%) as the holiday pay for the day.
- In case the employee’s duty goes beyond 8 hours on a special non-working day, he/she is entitled to receive an additional 30% of the hourly rate on said day (hourly rate of the basic wage x 130% x 130% x number of hours worked).
- If the employee works on a special non-working day that falls on a rest day, he/she is entitled to an additional 50% of the basic wage on the first eight hours of work (basic wage x 150%) on top of his/her basic salary for the day.
- In the case of an excess of eight hours during the special non-working day that is also supposedly a rest day of the employee, he/she is entitled to an additional 30% of the hourly rate on said day (hourly rate of the basic wage x 150% x 130% x number of hours worked).
December 25 (Christmas Day) and December 30 (Rizal Day):
- On a regular holiday, an employee is entitled to receive a 100% of the wage whether or not he/she reports to work. However, DOLE clarified that the employee even if he or she does not report for work, provided that the employee reports to work or is on leave of absence with pay on the day immediately preceding the regular holiday (basic wage x 100%).
- The employee should receive 200% of the wage if he or she reports for work during the regular holiday.
- In case an employee works for more than 8 hours, he/she is entitled to an additional holiday pay of 30% of the hourly rate on said day (hourly rate of the basic wage x 200% x 130% x number of hours worked).
- In case an employee who is supposedly on a rest day reports to duty that falls on a regular holiday, he/she is entitled to an additional 30% of the basic wage of 200% (basic wage x 200% × 130%).
- After the eight (8) hours, an employee who works on his/her rest day that falls on a regular holiday is entitled to an additional 30% of the hourly rate on said day (hourly rate of the basic wage x 200% x 130% x 130% x number of hours worked).
